Registered Childcare Draft Contract
BCMA PARENT AND CHILDMINDER CONTRACT February 2010
One copy to be kept by the Parent and one by the Childminders and when signed and dated by them is binding on both parties. Alterations should be signed and dated by both parties. This agreement is to be completed before any minding arrangements are entered into.

PAYABLE WEEKLY IN CASH IN ADVANCE
For weeks in which additional hours have been worked, the normal fee is payable weekly in cash in advance and the additional fees are payable at the end of the relevant week in cash.
a/ The fee remains the same if the child is absent FOR ANY REASON.
b/ The fee will be reviewed at least annually and one month's written notice will be given of any increase.
c/ Overtime will be payable at one and a half times the normal hourly rate should the child be collected later than the agreed time.
d/ Fees due during a holiday period to be paid prior to the holiday.
e/ Fees due during a period of illness to be paid at the normal time.
f/ A Registration fee of one week's money is payable when agreement is reached to care for the child - this is regarded as payment for the first week's fee.

4 HOLIDAYS
The childminders usually take holiday out of term time, (NB: our children do not always have the same holidays as LEA schools); a couple of weeks during the Summer holidays, some days over Christmas and in the Spring and perhaps one day each half term. The childminders reserve the right to take occasional days at other times if required.
a/ Please put holiday dates in writing.
b/ The childminders are entitled to 4 weeks holiday a year, plus all Public Holidays, on full pay. The childminders' holidays to be calculated initially from start date of the contract to 31 December, pro rata, and then between 1 January and 31 December each year. If more is taken than the entitlement, foc days or fee reduction will be offered in lieu. If less is taken than the entitlement, parents will make payment to the childminders in lieu of holiday.
c/ The childminders will give as much notice as possible, in writing, of their holidays as it is much better for the child if the parents can take their holidays at the same time.
d/ If your child starts or leaves the childminders part way through the year, or increases or decreases the number of days attendance, (4 weeks notice required for decreasing days), holidays should be paid proportionally - i.e.: one week holiday for each three months minding.
e/ If the parents take more than the childminders' 4 weeks holiday a year (see 4b above), the childminders must be paid at the full rate.

5 PARENTS TO PROVIDE
Changing bag containing nappies, wipes, cream, a change of clothing and a bottle for cow's milk. Formula milk feeds for babies under 1 year to be made up and provided by parents. Sun cream and sun hat/warm coat when necessary. Parents to provide baby (pureed) food and special diet if required.
6 MEALS PROVIDED
During normal attendance, lunch, drinks and snacks. Appropriate meals during any additional hours.
7 SICKNESS (See Sickness & Infectious Diseases Policy)
a/ If your child has been sick during the night you MUST inform the childminders so they can decide whether to admit your child or not. They have other children to care for who may be in danger of being infected.
b/ If your child has had an infectious illness the parent MUST contact the childminders before returning the child to their care.
c/ Should your child become unwell whilst in our care, we may call you to request you to collect your child as soon as possible.
d/ If your child has any medicine prescribed by the Doctor, the childminders must be informed and written permission given to administer medicine, in case of side effects.
e/ The childminders are not expected to give the child anything other than prescribed medicine.
f/ As required by Ofsted, please ensure that if the administration of any prescribed medication requires technical/medical knowledge then you arrange to provide individual training for the childminder from a qualified health professional.
g/ The childminders must inform the parents of any sickness in their own household.
h/ Your childminders are entitled to 1 week sick pay in any one year, to cover their own sickness or sickness/bereavement within their close family/friends. This will be calculated initially from start date of the contract to 31 December, pro rata, and then between 1 January and 31 December each year. If more is taken than the entitlement, foc days or fee reduction will be offered in lieu.

8 STUDY LEAVE
Your childminders are entitled to 1 week paid study leave during normal working hours or payment in lieu of training out of normal working hours in any one year. This will be calculated initially from start date of the contract to 31 December, pro rata, and then between 1 January and 31 December each year. If more is taken than the entitlement, foc days or fee reduction will be offered in lieu.

9 ACCIDENTS
The childminders must inform the parents of any accident/injury which takes place. Details must be entered into an Accident Record Book which will then be signed and dated by both parties.
10 NOTICE
a/ Four weeks notice in writing to be given by parent, or money in lieu.
b/ The parent must not give notice during the childminders' annual holiday.
c/ The childminders must give not less than 4 weeks written notice.
d/ Notice will not be required on the first four weeks as these are considered to be a trial period for both childminders and parent. Where the arrangement ends in these circumstances any money already paid in advance for days when the child will not be minded should be refunded.
11 DISCUSSION
Apart from urgent concerns which should of course be dealt with when they arise, lengthy discussions concerning the minded child or contract should be held at a mutually convenient (preferably child free) time.
12 SETTLING IN
The first two settling in visits are free of charge. Subsequent visits will be chargeable at the normal hourly rate.
13 RETAINING FEES
Should there be a delay between agreement to care for the child and the starting date a retaining fee of pounds per week is payable. (Half normal rate is suggested). This is non-refundable if parent has a change of mind but is refundable if the childminders change theirs. Should the childminders care for your child during this period, the full fee will become payable for the hours worked.
14 NURSERY
Nursery/playgroup fees are payable by the parent. When a minded child is at nursery/playgroup for part of the day, the childminders should receive the full day's fee.
